General terms and conditions

These general terms and conditions (“Terms”) govern access to and use of the FESIT service (“Service”) operated by Depole.io BV, Hondsstraat 16, 3700 Tongeren, Belgium, company / VAT number BE 0805.029.130 (“Depole”, “we”, “us”). Contact: hello@fesit.eu.

1. The Service

FESIT is a workspace for European organisations to map their IT stack and work toward a more Fair, Easy and Secure target. Depending on your account and plan, the Service may include:

• Public catalog — browse tools and offerings with curated Fair · Easy · Secure scores and evidence;
• Organisation workspace — Current and Target stacks, organisation policy (must-haves and pillar weights), and alternatives;
• My Stack — tools inventory, data-flow processes (outline and canvas), and domain / mail & DNS hygiene checks;
• Our stack strategy — cost · effort · risk board, multi-year outlook, Our usage (seats, spend, effort, dates), and a living Board report;
• Stack Migration Plan — Current → Target timeline and usage inventory;
• Open Tasks — near-term (“what we do in 90 days”) moves and policy priorities;
• Reports and exports — Board report (strategy one-pager), Stack report (full workspace PDF), JSON export, and (on eligible plans) CSV inventory import/export.

Catalog scores, strategy figures (including spend, effort euros and outlooks), Board and Stack reports, domain-check results and task lists are indicative guidance for discussion. They are not legal advice, not a DPIA, not an audit or security certificate, not a penetration test, and not a vendor ranking or commercial recommendation. Risk is never expressed as a euro amount.

Scores and dossier facts are based on publicly available information and curated catalog content. We do not install, penetration-test, or operationally evaluate products in a lab on your behalf. How scores are produced is described on How FES scores work.

2. Accounts, guest use and organisations

You may explore parts of the Service as a guest (temporary organisation) before registering. Guest work can be saved into a registered account or discarded. Guests do not unlock paid strategy features until they create or claim an organisation account.

To use the authenticated Service you must register with accurate information and keep your credentials confidential. You may create or join one or more organisations. You are responsible for activity under your account and for the content your organisation stores in FESIT (for example stacks, Our usage, policy choices, data flows, domains and notes).

Organisation administrators may invite or manage users and roles (for example admin, editor, viewer). Seat and domain limits may apply depending on your plan. If you lose access to an organisation, contact us at hello@fesit.eu.

3. Plans, fees and billing

Free access to the core workspace is available with soft limits (for example a capped number of fully editable migration-plan tools, and strategy economics that may be partially restricted). Paid plans unlock or expand Our stack strategy features.

Current paid products are Strategy Light and Strategy Full (names and entitlements as shown on Billing). Feature differences may include workspace seats, active domains, CSV inventory import/export, and clear access to strategy economics and reports. We may change plan names, prices or entitlements; material changes for existing subscribers will be communicated with reasonable notice where practicable.

Paid subscriptions are billed through Mollie. List prices are exclusive of VAT; Belgian VAT (currently 21%) is added at checkout where applicable. You must provide accurate billing details (legal name, address, and VAT number if used) before payment. Subscriptions renew automatically until cancelled according to the interval you chose (for example monthly commitment or yearly), as described on the billing pages and invoices.

Upgrades may take effect after a successful charge. Downgrades or cancellation to Free are typically scheduled to the end of the current paid period unless we state otherwise at checkout. Invoice PDFs and payment history are available in the Service for your organisation. Payment processing is subject to Mollie’s terms in addition to these Terms.

4. Reports, exports and your content

Board reports, Stack reports, JSON/CSV exports and on-screen strategy views reflect the data you entered and our catalog methods at generation time. You are responsible for verifying figures before board or procurement decisions. Regenerating a report after you change inventory or economics may change the output.

You retain ownership of the data you enter. You grant Depole a limited licence to host and process that data solely to provide, secure and improve the Service. Public catalog pages may be viewed without an account.

5. Acceptable use

You agree not to:

• use the Service unlawfully or to infringe others’ rights;
• attempt to gain unauthorised access to the Service, accounts or related systems;
• probe, overload or disrupt the Service except through agreed security testing;
• scrape or bulk-export the catalog or other users’ data in a way that harms availability or violates these Terms;
• abuse billing, guest trials, invites or exports to circumvent plan limits;
• upload malware or content that is unlawful, defamatory or otherwise harmful.

We may suspend or terminate access if we reasonably believe these Terms are breached.

6. Intellectual property

Depole and its licensors own the Service, branding, software and curated catalog content (including score methodologies and published pattern bands). Copying substantial catalog content for competing products without permission is not allowed.

7. Availability and changes

We aim for a reliable Service but do not guarantee uninterrupted or error-free operation. Features, catalog entries, scores, domain-check results and report layouts may change. Third-party dependencies (for example payment providers or PDF rendering) may affect availability of specific features.

We may update these Terms; the “Last updated” date will change. Continued use after notice constitutes acceptance of material changes where permitted by law. For material changes that affect paying subscribers, we will provide reasonable notice where practicable.

8. Liability

To the fullest extent permitted by Belgian law, Depole is not liable for decisions you make based on FESIT scores, strategy outlooks, Board or Stack reports, domain checks, task lists or recommendations, nor for indirect or consequential loss (including lost data, business interruption or third-party claims), except in cases of intent or gross negligence, or where liability cannot be limited by law (including liability for death or personal injury caused by negligence, and mandatory consumer protections if they apply).

Where liability can be limited, our aggregate liability arising from the Service in any twelve-month period is limited to the fees you paid us for the Service in that period (or €100 if no fees were paid).

9. Privacy

Personal data is processed as described in our Privacy policy and Cookie policy. Organisation content you enter is typically processed for your organisation as described there.

10. Termination

You may stop using the Service at any time. You may cancel a paid subscription according to the options shown on Billing (access usually continues until the end of the paid period). You may request account closure via hello@fesit.eu. We may discontinue the Service or close accounts with reasonable notice where practicable, or immediately for serious breach, unpaid fees or legal risk.

11. Governing law and disputes

These Terms are governed by Belgian law. Courts of the judicial district of Limburg (Belgium) have jurisdiction, without prejudice to mandatory rules that give you a right to bring proceedings elsewhere.
