General terms and conditions

These general terms and conditions (“Terms”) govern access to and use of the FESIT service (“Service”) operated by Depole.io BV, Hondsstraat 16, 3700 Tongeren, Belgium, company / VAT number BE 0805.029.130 (“Depole”, “we”, “us”). Contact: hello@depole.io.
1. The Service
FESIT helps organisations inventory IT tools, compare them against Fair, Easy and Secure criteria, and document a target stack. Catalog scores and assessments are guidance for discussion. They are not legal advice, not a DPIA, not an audit certificate, and not a vendor ranking or commercial recommendation.
2. Accounts and organisations
To use the authenticated parts of the Service you must register with accurate information and keep your credentials confidential. You may create or join one or more organisations within the Service. You are responsible for activity under your account and for the content your organisation stores in FESIT (for example stacks, notes and policy choices).
Organisation administrators may invite or manage users. If you lose access to an organisation, contact us at hello@depole.io.
3. Acceptable use
You agree not to:
- use the Service unlawfully or to infringe others’ rights;
- attempt to gain unauthorised access to the Service, accounts or related systems;
- probe, overload or disrupt the Service except through agreed security testing;
- scrape or bulk-export the catalog in a way that harms availability or violates these Terms;
- upload malware or content that is unlawful, defamatory or otherwise harmful.
We may suspend or terminate access if we reasonably believe these Terms are breached.
4. Intellectual property
Depole and its licensors own the Service, branding, software and curated catalog content. You retain ownership of the data you enter. You grant us a limited licence to host and process that data solely to provide and improve the Service.
Public catalog pages may be viewed without an account. Copying substantial catalog content for competing products without permission is not allowed.
5. Availability and changes
We aim for a reliable Service but do not guarantee uninterrupted or error-free operation. Features, catalog entries and scores may change. We may update these Terms; the “Last updated” date will change and continued use after notice constitutes acceptance of material changes where permitted by law.
6. Fees
Unless we agree otherwise in writing, access to FESIT under these Terms is provided without a separate subscription fee. Paid plans or custom agreements, if introduced, will be described separately.
7. Liability
To the fullest extent permitted by Belgian law, Depole is not liable for decisions you make based on FESIT scores, reports or recommendations, nor for indirect or consequential loss (including lost data, business interruption or third-party claims), except in cases of intent or gross negligence, or where liability cannot be limited by law (including liability for death or personal injury caused by negligence, and mandatory consumer protections if they apply).
Where liability can be limited, our aggregate liability arising from the Service in any twelve-month period is limited to the fees you paid us for the Service in that period (or €100 if no fees were paid).
8. Privacy
Personal data is processed as described in our Privacy policy and Cookie policy.
9. Termination
You may stop using the Service at any time. You may request account closure via hello@depole.io. We may discontinue the Service or close accounts with reasonable notice where practicable, or immediately for serious breach or legal risk.
10. Governing law and disputes
These Terms are governed by Belgian law. Courts of the judicial district of Limburg (Belgium) have jurisdiction, without prejudice to mandatory rules that give you a right to bring proceedings elsewhere.
